Car crashes are among the most common reasons for injury lawsuits. Whether your accident was a minor incident or a major collision, our legal team can help you obtain fair compensation from the at-fault driver.
While we should include the at-fault driver or drivers in the case, others might also be implicated. For example, employers may be held vicariously liable if the at-fault driver was working at the time of the crash. While insurance is often an option, it might not be enough to cover all your damages. In such cases, a lawsuit may be your best option for fair compensation, and our lawyers are here to help.

Car accidents can be complicated, and it might not be immediately apparent who is responsible. Below are possible defendants to consider with your attorney.
We should almost always examine the other driver involved in an accident, especially if they are the only other driver involved. If they were speeding, failed to signal, were driving recklessly, or committed any number of other common traffic code violations, they may be held liable.
In multi-vehicle accidents, more than one other driver may be held responsible. Such accidents can be complex, and we may need help from accident reconstruction experts to determine how the accident happened and who is to blame. There is no limit to how many defendants you can sue, and you may sue as many people as necessary.
If one of the at-fault drivers was working when the accident occurred (e.g., delivery drivers, truck drivers, limo drivers), our car accident lawyers may include their employer in the lawsuit. Employers may be held vicariously liable for injuries caused by negligent employees if the employee was acting in furtherance of normal job duties when they caused the accident.
Alternatively, employers may be held directly liable if they knew the employee was unfit for the job (i.e., driving) yet hired them anyway.
We must carefully evaluate all your damages so we don't overlook or undervalue anything.
Car accidents often cause severe injuries, and you may have incurred significant medical bills. We must include all medical costs directly related to the car accident in your case. We can also calculate your future medical costs if you require medical care beyond the duration of your lawsuit.
The cost of repairing or replacing your vehicle, as well as any personal property that may have been inside it during the accident, should be accounted for. Vehicle damage can be quite expensive, and these costs may be substantial.
Your injuries from the accident may prevent you from returning to work, and you may lose significant income while you recover. We must calculate the income you have lost so far and the income you may continue to lose as long as you cannot work and add it to your claims.
Car accidents may cause damage that cannot be proven with evidence of cost. Non-economic damages, including pain and suffering, may be quite substantial, especially if you have long-term or permanent injuries that interfere with your quality of life.
In Indiana, drivers can file third-party claims with the at-fault driver’s liability insurance, and they must provide evidence demonstrating the other driver’s fault for the accident.
Unfortunately, insurance can be limited, or the insurance company can deny your claim. On the other hand, the insurance company might offer a low-ball settlement, which you do not have to accept.
If the at-fault driver is uninsured, you may file a claim with your own uninsured or underinsured motorist coverage. These policies are designed for situations like this and can help you get the compensation you need.
Alternatively, we may look for alternative defendants. If the driver is uninsured, we may be able to sue their employer if they were on duty at the time of the accident.
Whether to accept an insurance settlement is up to you. Once you accept an insurance settlement, your case is over, and you likely cannot take your claims to court for additional damages.
If you are interested in an insurance settlement, talk to a lawyer about how much your claims are truly worth. If the insurance company refuses to offer a fair settlement, we can take your case to court.
It is a good idea to contact the police after a car accident, especially if it is serious. If an accident involves property damage worth at least $1,000, bodily injuries, or death, you are required by law to call the police.
You can start collecting evidence by taking photos and videos of the accident scene while waiting for help. Your recordings may preserve crucial details that would otherwise be lost after the authorities clear the scene.
You must also exchange information with other drivers and witnesses. We need the at-fault driver’s information to file insurance claims or lawsuits, and knowing potential witnesses' names makes it easier to find them later.
Insurance settlements are usually faster and may take only a few short months to complete. Less severe accidents may result in insurance payouts in only a few weeks.
Trials take longer but often yield larger damages awards. It may take at least several months to bring the case to trial, and the trial itself could last several weeks. If the accident is severe or involves more complicated facts, it could take a year or more before a plaintiff sees any compensation.
Causing a car accident is not necessarily a criminal offense, but a driver may be charged depending on the circumstances and their behavior.
If the at-fault driver was especially reckless, they may be cited for reckless driving, but this is a traffic citation, not a criminal charge. Charges will likely result if the at-fault driver was intoxicated or is believed to have caused the accident on purpose, such as in a road rage incident.
In Indiana, car accident victims have only 2 years from the day of the accident to file a civil lawsuit. If you do not file your case during this time, you may be time-barred from doing so, and you might be unable ever to recover fair compensation.

Don is a founding partner and one of the nation’s top-ranked personal injury litigators. He is a member of the Multi-million Dollar Advocates Forum, which includes less than 1% of the nation’s trial lawyers, and awarded the highest ranking given by Martindale Hubbel and AVVO.
More importantly, Don understands representing personal injury victims is about more than recovering the best settlement: it’s about helping clients get back on their feet and supporting them in every aspect of their recovery.

In nearly all cases, our clients seek compensation from the wrongdoer’s insurance company. Before forming Wruck Paupore, Jason worked for a prominent law firm representing some of the world’s largest insurers. This experience gives Jason a deep understanding of the insurance industry and the strategies it uses to pay injury victims as little as possible.
Jason -- and our entire team -- put this inside knowledge to work to force insurance companies to pay what is actually owed. Often, we use the insurance company’s own tactics against them as we fight for the full compensation our client deserves.

For more than four decades, Keith has been fighting for injury victims. During that time, he’s watched the insurance industry change, with insurers now more interested in protecting their stock price than treating injury victims fairly.
Since the beginning, Keith has put people first. From his childhood in Gary, Indiana during the 1960’s and working his way through law school, Keith has risen to become one of the Midwest’s most respected trial lawyers. He has never forgotten that being a lawyer is about helping people -- and seeing injury victims through struggles in a way that could change their lives forever.
Over the decades, Keith, Don and Jason have fought relentlessly for clients, even when other lawyers have said the case was impossible to win.
