You will want to begin documenting your accident as soon as it happens. You need evidence to help reconstruct the incident and support your claims regarding the defendant’s negligence. Do not hesitate to call 911 after suffering a personal injury. You might naturally think to do this after certain accidents, like car crashes, but you can call for help after suffering any personal injury. For instance, if you slip and fall in a store, you can call 911 to get emergency medical care and document the accident with the police. Paramedics can provide you with treatment on the scene while the police investigate the accident for their report. During this time, speak to the police and describe as many details as you can remember. However, do not offer additional commentary that might be construed as accepting fault for the accident.
The police will also note whether you accepted care on the scene. It is always a good idea to get care when you need it then and follow the advice of emergency services. You should also report your accident to a business owner if your accident occurred in a commercial location. An employee or manager will usually file an accident report with the company afterward, which you should get a copy of. Photo evidence is typically the next best thing to having physical evidence. However, a great deal of physical evidence cannot be brought into court. For instance, you cannot bring a damaged vehicle into court. Fortunately, photo evidence can preserve details that will likely be unavailable later and be submitted in your claim. After your accident, be sure to take pictures of its fallout, including the scene and your injuries.
What to photograph at the accident scene will depend on the type of accident you were injured in. If you were injured on another’s property, take photos of the hazardous condition that injured you. For example, if you fell down a poorly lit stairwell, photograph it to show what it was like at the time you were injured before the property owner has a chance to fix the condition. If you were in a car accident, photograph the vehicle damage and other important details, like road debris, traffic signs, and road markings. If you claim that the other driver went over the double lines, take pictures of the traffic lines to back up these claims.
While it might be difficult, given that you just suffered a debilitating injury, it is important to document it while it is still fresh. Take multiple pictures of any visible injuries you endured or ask someone to help you if you are too injured to take them yourself, like the police or paramedics. Pictures of your injuries will link the cause of your accident to your damages. They will also show the severity of your harm at its worst. Legal claims take time, and your injuries might significantly heal with the time you are fighting your case. With photo evidence, there will be little doubt about how damaging your injuries are.
Some accidents have several witnesses to it, while others only have a few. It depends on where your accident occurred. If you were injured in a commercial location or car accident, a few people might offer to help. If so, and your injuries allow you, speak to witnesses while on the scene. If eyewitnesses do not talk to the police and you do not get their information, you might have no way of contacting them later. Again, ask the police or paramedics to speak to witnesses on your behalf if you are too injured to do so.
